What happens to one's property when they die without a Will?
If legally married at the time of death, the spouse of the Decedent is entitled to what is know as the "preferential share" of the estate with the balance then being divided in varying proportions, depending upon the number, between spouse and children, possibly to other family members.
If no family members can be located, then the Estate will become the property of the Crown.
